{"id":37557,"date":"2026-05-22T11:18:05","date_gmt":"2026-05-22T07:48:05","guid":{"rendered":"https:\/\/rukhshana.com\/en\/?p=37557"},"modified":"2026-05-25T21:39:44","modified_gmt":"2026-05-25T18:09:44","slug":"taliban-legitimising-child-marriage-with-new-edict-activists-warn","status":"publish","type":"post","link":"https:\/\/rukhshana.com\/en\/taliban-legitimising-child-marriage-with-new-edict-activists-warn\/","title":{"rendered":"Taliban \u2018legitimising child marriage\u2019 with new edict, activists warn"},"content":{"rendered":"\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>By Zahra Joya<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> Child marriage appears to have been legally recognised for the first time by the Taliban in Afghanistan, as activists say \u201cshameful\u201d new laws make it almost impossible for girls and young women to seek divorce against their husbands\u2019 will.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are no official statistics on forced and underage marriages in Afghanistan, but activists say it has risen at an alarming rate in recent years, driven by the&nbsp;ban on girls being in education after the age of 11.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One informal estimate suggested that since the Taliban had barred them from education about&nbsp;<a href=\"https:\/\/afghanhrcenter.org\/wp-content\/uploads\/2025\/01\/Access-to-Education-for-Women.pdf\">70% had been pushed into early or forced marriage<\/a>&nbsp;and that 66% of these marriages involved girls under the age of 18.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no ban on child marriage in&nbsp;Afghanistan&nbsp;under the Taliban, but a new law on divorce approved last week appears to suggest that a girl who later says she was married against her will would not be permitted a divorce if her husband disagrees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new law also appears to suggest that a woman cannot divorce her husband solely on the grounds of his absence or failure to provide financial support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There have been reported demonstrations against the new law in Afghanistan\u2019s capital, Kabul, this week, with several women\u2019s rights movements condemning the law as a form of&nbsp;systemic violence against women and children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One activist, Fatima, said: \u201cAfter issuing hundreds of anti-women decrees, the&nbsp;Taliban&nbsp;are now attempting to institutionalise child marriage within the formal legal structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cInstead of ensuring security and justice, the Taliban are occupied with issuing shameful misogynistic decrees and suppressing human freedoms.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The UN Assistance Mission in Afghanistan (UNAMA) also expressed concern over the legislation. \u201cThe decree, which codifies principles governing the separation of spouses, represents another step in the erosion of Afghan women and girls\u2019 rights and further entrenches systemic discrimination in law and practice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Georgette Gagnon of UNAMA said the new law was \u201cpart of a broader and deeply concerning trajectory in which the rights of Afghan women and girls are being eroded \u2026 [it] entrenches a system in which Afghan women and girls are denied autonomy, opportunity and access to justice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Taliban government spokesman dismissed criticism of the group\u2019s newly published legislation. Speaking to the Taliban-run National Radio and Television, he said: \u201cWe should pay no attention to the protests of those who are hostile, who have problems with Islam, with religion and with the foundations of the Islamic system.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recent research from the&nbsp;<a href=\"https:\/\/afghanhrcenter.org\/en\/report-on-the-human-rights-situation-in-afghanistan-in-1404\/\">Afghanistan Human Rights Center<\/a>&nbsp;has found that most victims of child marriage in the country reported domestic violence and severe psychological distress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier this month, a 15-year girl in Daikundi province, central Afghanistan, died after enduring months of domestic violence, including severe beatings by her husband. Her father said his daughter had married her cousin eight months ago, but the violence began only two months into the marriage.
