{"id":37785,"date":"2026-09-11T13:20:09","date_gmt":"2026-09-11T09:50:09","guid":{"rendered":"https:\/\/rukhshana.com\/en\/?p=37785"},"modified":"2026-09-11T14:19:59","modified_gmt":"2026-09-11T10:49:59","slug":"afghan-woman-seeking-divorce-from-violent-husband-says-taliban-judge-hassled-her-for-sex","status":"publish","type":"post","link":"https:\/\/rukhshana.com\/en\/afghan-woman-seeking-divorce-from-violent-husband-says-taliban-judge-hassled-her-for-sex\/","title":{"rendered":"Afghan woman\u00a0seeking divorce\u00a0from violent husband\u00a0says Taliban judge hassled her for sex\u00a0"},"content":{"rendered":"\n<p class=\"has-text-align-center wp-block-paragraph\"><strong><em>By Raha Azad<\/em>&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When&nbsp;Kamela&nbsp;applied to&nbsp;divorce&nbsp;her&nbsp;violent husband&nbsp;following 13 years of abuse,&nbsp;she hoped the&nbsp;court&nbsp;in northern Afghanistan&nbsp;would&nbsp;bring&nbsp;a swift end to her&nbsp;toxic marriage.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, she&nbsp;says&nbsp;one&nbsp;judge&nbsp;pestered her for&nbsp;sex&nbsp;while another&nbsp;told her that a man was entitled to hit his wife.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although&nbsp;the&nbsp;court eventually granted her a&nbsp;divorce,&nbsp;it came at&nbsp;a&nbsp;very&nbsp;high&nbsp;cost&nbsp;&#8211;&nbsp;the&nbsp;judge whose advances she had spurned&nbsp;handed&nbsp;custody&nbsp;of her four&nbsp;children&nbsp;to&nbsp;her ex.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kamela\u2019s story&nbsp;illustrates&nbsp;how difficult it&nbsp;is&nbsp;for a woman&nbsp;to seek divorce in Taliban-ruled Afghanistan.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the 31-year-old filed&nbsp;for divorce earlier this year,&nbsp;she cited&nbsp;her&nbsp;husband\u2019s drug addiction and&nbsp;violence as grounds for separation.&nbsp;In one attack, she says&nbsp;he&nbsp;broke her arm. Other&nbsp;injuries&nbsp;sustained during beatings&nbsp;included&nbsp;a&nbsp;leg&nbsp;fracture and a dislocated&nbsp;wrist.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But&nbsp;Kamela&nbsp;said&nbsp;the judges&nbsp;and court officials&nbsp;repeatedly&nbsp;told her to&nbsp;live&nbsp;with the&nbsp;violence&nbsp;and asked her why she wanted to&nbsp;\u201cruin\u201d&nbsp;her life&nbsp;by leaving&nbsp;her&nbsp;marriage.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey told me to put up with it, but this man, who was addicted to drugs, punched and kicked me every day,\u201d&nbsp;Kamela&nbsp;told Rukhshana Media.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She&nbsp;said one judge&nbsp;even&nbsp;told her:&nbsp;\u201cThere is nothing wrong with a husband beating his wife. Islam allows it.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Divorce has always been&nbsp;stigmatised&nbsp;in Afghanistan, but the&nbsp;previous&nbsp;Afghan&nbsp;government had&nbsp;sought&nbsp;to&nbsp;help&nbsp;women escape&nbsp;violent marriages&nbsp;by&nbsp;setting up&nbsp;specialist&nbsp;courts to deal with&nbsp;family matters and&nbsp;domestic&nbsp;abuse.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After&nbsp;seizing&nbsp;power in&nbsp;2021, the Taliban&nbsp;dismantled&nbsp;the courts&nbsp;and&nbsp;shut&nbsp;shelters for domestic abuse&nbsp;victims.&nbsp;<br>&nbsp;<br>U.N.&nbsp;rights&nbsp;experts say a new&nbsp;Taliban&nbsp;decree&nbsp;on the&nbsp;\u201cseparation of spouses\u201d&nbsp;published in May&nbsp;will&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2026\/06\/afghanistan-taliban-decree-separation-spouses-further-erodes-rights-women\" target=\"_blank\" rel=\"noopener\">make it even harder&nbsp;for women&nbsp;to seek divorce<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rukhshana Media has previously reported on cases where\u00a0Taliban\u00a0courts have told women\u00a0trying to leave a  violent\u00a0marriage\u00a0<a href=\"https:\/\/rukhshana.com\/en\/teenager-imprisoned-in-balkh-province-for-seeking-divorce\/\" target=\"_blank\" rel=\"noopener\">to\u00a0stay\u00a0with their husband\u00a0or go to prison<\/a>.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2018JUDGE ASKED FOR SEX&#8217;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kamela, who was 17 when her parents arranged her marriage, said her father had supported her decision to seek a divorce&nbsp;and had&nbsp;accompanied&nbsp;her on her trips to court.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the divorce she moved back to&nbsp;live with&nbsp;her parents,&nbsp;but the&nbsp;court ordered that her two girls and two boys,&nbsp;aged six, eight, 11 and 12, should live with their father&nbsp;who has blocked contact.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kamela is heartbroken.&nbsp;She sometimes speaks to her children by phone&nbsp;with the help of a&nbsp;neighbour, but has not seen them for months.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s so difficult to be a woman in this country and want a divorce,\u201d she said.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the court considered&nbsp;her&nbsp;case,&nbsp;Kamela&nbsp;said&nbsp;she&nbsp;was shocked to&nbsp;receive&nbsp;a phone call from one of the judges&nbsp;suggesting&nbsp;he could&nbsp;help her&nbsp;win&nbsp;custody&nbsp;if she slept with him.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe said, \u2018If you become friends and intimate with me, we will find a way for you to get&nbsp;your children, or at least your daughters.\u2019.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The call left her very distressed.&nbsp;\u201cI&nbsp;couldn\u2019t&nbsp;sleep all night.
